Statute
Md. Code Ann., Crim. Proc. § 8-302
Survivors of trafficking may file a motion to vacate a conviction for prostitution if they committed the offense while they were being trafficked. Unfortunately, Maryland is one of only three states where a survivor’s motion to vacate must be signed and consented to by the prosecutor’s office in the county that originally convicted them before they can file it with the court.
There is no time limitation to file, however the motion must be made within a reasonable period after the conviction.
