Statute

Ky. Rev. Stat. § 529.160.

Survivors of trafficking may bring a motion to expunge all records of non-violent offenses that were committed as a direct result of being a victim of human trafficking. The motion cannot be filed until sixty days after the final judgment was entered by the court.

Survivors are not required to provide official documentation, but that documentation creates a presumption that the defendant’s participation in the offense was a direct result of being a victim of trafficking. If the court expunges the record, the case is deemed to be dismissed with prejudice.
