Statute

SDCL § 26-7A-115.1

South Dakota does not offer criminal record relief to survivors who were arrested and prosecuted as adults.

There is limited relief available for survivors seeking to expunge juvenile delinquency records that resulted from being a victim of human trafficking or sexual exploitation.  However, this provision does not apply to any adult arrest records or convictions. For information on general criminal record clearance, please visit the Clean Slate Clearinghouse.
