N.D. Cent. Code §12.1-41-14

In North Dakota, survivors may petition the court to vacate convictions for prostitution, misdemeanor forgery, misdemeanor theft, certain credit offenses, and certain controlled substance offenses. The petition must demonstrate that the survivor’s participation in the offense was a direct result of being a victim of trafficking.

The statute permits survivors to submit official documentation to create a presumption of trafficking. Though not required, if a survivor can provide official documentation, the presumption reduces the burden of proof on the survivor.
